Disciplinary Action

The official document states:

OFFICIAL STATEMENT OF CHARGES

COLONIAL FLEET

Judge Advocate General's Office


In accordance with Colonial Fleet regulations, CREWMAN SPECIALIST CALLY TYROL has been duly charged with the crime of INSUBORDINATION.

Details of charge: Specialist Tyrol did knowingly and willingly fail to show proper respect of rank and commission towards flight officer Lieutenant Sharon Agathon by means of a journal entry. This journal entry was posted publicly viewable by almost the entirety of the ship's crew, including Lt. Agathon. Within this entry, Specialist Tyrol did impugn the reputation and defame the personality of Lt. Agathon with malicious intent.

Actions taken: Due to the highly sensitive and public nature of the incident, Major Lee Adama, Commander of the Air Group, has taken primary role in this matter, by order and consent of Admiral William Adama, CO Galactica. The Crewman's direct superior, Chief Petty Officer Galen Tyrol, will be expected to assist in the dispensing of any disciplinary action.


I will now hear from the involved parties regarding this incident.

I would like to note, for the record, that it seems irregular for the CAG to take primary role as judge and jury in this matter, as the matter is not confined to two members of his flight crew.

I've been authorized by the accused to request a full hearing on her behalf.

You're correct, Chief, it is very irregular. However, in the interest of expediency, and the fact that I am the third ranking officer on the ship, the hope is that this can be seen to as efficiently and fairly as possible. Also, you should know that all decisions leveled in this case will be reviewed by both the XO and the Admiral.

I'm sorry, sir, but given the fact that I was excluded up until now for the sake of non-biased judgment, I'm hoping you'll be taking this to neither Captain Agathon (for the same reason I was not included) nor Colonel Tigh (as the past has shown him to be biased against Lieutenant Agathon).

I plead no contest to the charge of defamation. I would, however, if it please the convening authority, take exception to the charge of outright insubordination to the lieutenant.

My request to the convening authority is a matter of private record. I do request the opportunity to explain my actions and the events leading up to the incident in question. While my response was not such as worthy a member of the Colonial Fleet, the convening authority has showed a complete lack of interest in hearing my side of the story privately, which leads me to believe that I've already been judged and sentenced before the statement of charges was already filed.

All I want is the opportunity to explain myself and face my accusers. If I'm to be held accountable for my actions, so should we all.

First of all, I want you to know that I know what I did was wrong. And I'm not going to hide behind the Chief, or anyone else. If you honestly believe that what I did was so horrible that a brig stay is the only way to teach me a lesson, I won't fight it.

Do you have any idea what it's like to be made to feel like your worth to this ship, this crew, humanity itself, can be measured in decimal points? Wait, you're the CAG, of course you don't.

I realize we're here to discuss my actions, but they were a reaction to someone else's actions. I may not be the smartest cookie in the jar (case in point, the fact we're here today), but I'm not deaf and I'm not completely oblivious. The reason I wrote what I did was because I couldn't even eat, or sleep, or take care of my son. I know I shouldn't have let it get to me, but when you get a gun shoved in your hand and dared to shoot it, then suddenly looking down the barrel of that same gun, logic doesn't exactly win out.

I made a mistake. We've all made mistakes. Mine's more public than most and I understand that there needs to be a statement made. But someone's already used me to make a statement.

I know it seems like I'm trying to play the victim and I know that in some ways I had something coming to me. But I don't deserve to be terrorized any more than Lieutenant Agathon deserves to be slandered. She didn't mean to terrorize me? I didn't mean to slander her.

I'm truly sorry, not only for the comments themselves, but for the trouble they've caused.

I would like to add, for the record, that I was the one who encouraged Specialist Tyrol to leave her journal entry public. I found it first and after discussing it with her, told her that she should hide it from certain... superior officers and leave it for Lieutenant Agathon to find and respond to.

On the matter of the charges against Specialist Tyrol, speaking as the defamed party in question-- if Galactica command has determined that the Major's judgement is the best manner in which to approach this problem, I trust in Major Adama's fairness and will abide by any decisions he makes.

I expect that certain details regarding a past encounter between Specialist Tyrol and myself are likely to be referenced and that it is possible charges stemming from it may be leveled against me. I would explain the extenuating circumstances that surrounded the event, but in all likelihood, it wouldn't make a difference in the outcome.

You really think I'd put up with hearing something like coming out of her mouth, whether it was directed at you or not? I thought I was trusted to discipline my own crew when needed. Not only didn't you come to me the first time, you didn't bother to inform me, Cally's direct superior, that you were bringing charges against her. If one of the other pilots hadn't told me something was about to go down, when would I have found out? When they came down and picked her up to face the charges against her?

What if that gun had gone off accidentally while one of you was holding it? Then again, in the interest of our friendship, it might be better if we hold off on discussing that for a few days, let it sink in.

You should have come to me. This whole damn thing could have been avoided if you'd trusted me to discipline her. The ironic thing? She was disciplined.

Honestly, I had assumed the issue was between myself and your wife. I had also assumed at the time that we had settled matters between ourselves without having to bring you or anyone else into this.

Why would I tell you I was bringing charges against her? To rub it in your face? Sorry, I don't work that way. Whatever problems Cally and I have, I'm not the sort of person to make it personal with you. I was trying to spare you from all of this.

This isn't about my wife. This is about a member of my deck crew showing disrespect to a superior officer and I wasn't informed. It's my job, Lieutenant, to keep my people in line, including my wife.

So you let her believe you were holding a loaded weapon against her. I guess I have you to thank for a week of sleepless nights then.

Lieutenant, I sincerely hope that there won't be a next time, but if there is, please just give me a little more credit than you did this time. We could've avoided a lot of trouble if you had just sat down with me and explained what was going on.
